Definitions 

Supplier: Means the Company “Water Culture Filtration Pty Ltd”

Customer: Means the party identified who orders products or services and noted on the order purchase as “customer” , this includes the customer’s agent and permitted assignees

Agreement: Means any agreement entered into for supply of good and services between the supplier and the customer 

Equipment: Means the goods to be supplied under the Agreement and includes parts and supplies which may subsequently be supplied under any warranty given in relation to the Equipment 

Goods: Means the equipment provided by the Supplier to the Customer as described in the purchase order and any accompanying documentation (in any form) provided with the equipment

Services: Means installation, repair and/or maintenance work carried out by the supplier.

Acceptance of Terms of Use

    1. Please read the below Terms and Conditions before using our website.
    2. These Terms and Conditions govern your access and use of this website. 
    3. By using this website, you agree to accept the Suppliers Terms and Conditions and accept to be bound and abide by these Terms and Conditions. 
    4. All users of this Website must be over 18 years of age.
    5. All information collected on this Website is subject to our Privacy Policy. By using our Website you are consenting to all actions taken by us with respect to your information in compliance with our Privacy Policy.

Intellectual Property

    1. Unless otherwise stated, the Supplier owns the intellectual property rights for all material on this Website. All intellectual property rights are reserved. 
    2. Unless otherwise agreed in writing with the Supplier, the Supplier does not consent to the republishing or preproduction of material from this Website; the sale, hire or sub-licence of material; or the redistribution of content from this Website.

    1. Any links to third party website within this Website are provided for your convenience only.
    2. Supplier takes no responsibility over the content of third party sites or any loss and/or damage caused by the use of third party websites.
    3. The Company is not responsible for the privacy practices of third party sites and encourage users to read the privacy statements of any other site that collects personally identifiable information.

Online Purchases

    1. All purchases made via our Website or other transactions for the sale of goods or services formed through the Website are governed by our Sales Terms related thereto, a copy of which is attached to or referenced in our sales documents.
    2. In purchasing goods or services, you are agreeing  to provide personal and financial information .
    3. We reserve the right to limit the order quantity on any product or service and/or refuse service.

Pricing

    1. All prices are quoted in Australian dollars unless otherwise stated.
    2. Any pricing of items is subject to change without notice.
    3. Unless otherwise agreed in writing, prices specified by the Supplier whether by quotation, orally, price list or on this website, for the supply of the goods and services excludes taxes, duties (including import levies and duties) on or in relation to the goods and services, including, without limitation GST.

Shipping

    1. Estimated shipping and delivery costs will be calculated when an order is placed. This is based on the availability of the goods and chosen shipping options

Delivery

    1. The Supplier will arrange for the delivery of the goods to the Customer, at the Customer’s cost and delivery of the goods will be deemed to have occurred upon delivery of the goods to the Site.

Delivery Dates

    1. The Customer acknowledges and agrees that delivery dates represent only an estimation of the date of the delivery of the Equipment and are not binding on the Supplier.
    2. The Customer indemnifies the Supplier from any costs, losses, expenses, claims or actions arising out of any such delay.

Installation

    1. Must be installed by a licensed plumber.
    2. Please refer to the technical sheet / instruction manual as detailed on our Website. 

Returns Policy

    1. We have a thirty (30) day returns policy. This is subject to the product not having been used or damaged after delivery and remaining in the original packaging.
    2. Without limiting the customers rights, requests for returns will not be effective unless all requests are in writing to the Supplier as per the Suppliers nominated address nominated below under ‘Notices’ and until accepted by the Supplier in writing.
    3. If any Equipment received by the Customer does not comply with the Customer’s order, the Customer must advise the Supplier within seven (7) days or else the Equipment shall be deemed to have been accepted by the Customer.
    4. If the Customer is deemed to have accepted the goods and services and will be bound to pay for them.
    5. The Supplier will not accept any goods or equipment that are altered in any way or are damaged due to not being stored or handled in accordance with the Suppliers instructions or legislative requirements.
    6. The Customer will be responsible for any freight charges in association with the return of the goods.
    7. The Customer must return the goods in new condition together with proof of purchase and original packaging, where possible.
    8. The Supplier has absolute discretion to accept the return of any goods for credit within fourteen (14) days of receiving the returned goods from the Customer.

Sub-Contracting

    1. The Supplier reserves the right to sub-contract the manufacture and/or supplies of the goods or any part thereof to a third party.

Indemnity

    1. Except where prohibited by law, by using this Site the customer indemnifies the suppliers for any loss, damage, cost or expense arising from a customer’s negligence or failure to install or operate the goods in accordance with our recommended installation and operation instructions  and manuals. 
    2. The customer hold harmless Water Culture Filtration Pty Ltd and our directors, officers, agents, employees, subsidiaries and affiliates from any action, claims, losses, damages, liabilities and expenses including legal fees arising out use of our Site or the customers violation of these Terms and Conditions.

Product Liability

    1. The Supplier is not liable for any indirect or consequential losses or expenses suffered by the Customer or any third party, however caused, including but not limited to loss of turnover, profits, business or goodwill or any liability to any other party.
    2. The Supplier is not liable for any loss or damage suffered by the Customer or any third party where the supplier has failed to deliver goods or services or fails meet any delivery date or cancels or suspends the supply of goods or services.

Consumer Protection Laws

    1. Under the Australian Consumer Law contained in the Competition and Consumer Act 2010 (Cth), the Customer may be entitled to certain non excludable rights, protections and remedies. Nothing within these Terms and Conditions intends to restrict the effect of these rights, protections and remedies.

Warranty

    1. In addition to any certain non-excludable rights, protections under Australian Consumer Law contained in the Competition and Consumer Act 2010 (Cth), the Customer is entitled to the warranties that are described and referred to in the Warranty documentation. 
    2. Please refer to the warranty manual/information as detailed on our Website.

Termination

    1. We may terminate or suspend you access to our Site immediately, without prior notice or liability for, for any reason including breach of these Terms and Conditions. 
    2. Upon termination, your right to use the service will cease immediately.

Dispute Resolution

    1. The user agrees to contact the Company to firstly resolve concerns or disputes, through dispute resolution.

Governing Law and Jurisdiction

    1. All matters relating to the Website and these Terms and Conditions are governed by the laws of the State of New South Wales

Severability

    1. It at any time any of the provisions set forth in these Terms and Conditions are found to be inconsistent or invalid under applicable law, these provisions will be  deemed void and will be removed from these Terms and Conditions. All other provisions will not be affected by the removal and the reset of these Terms and Conditions will still be considered valid.

Changes to the Website

    1. These Terms and Conditions may be amended from time to time in order to maintain compliance with the law and reflect any changes to the way we operate our Site and the way we expect users to behave on our Site. We will notify users by email of changes to these Terms and Conditions or post a notice on our Site.
